DEL PLIEGO<br \/>\nB.1 Nombre y Raz\u00f3n Social.<br \/>\nB.2 Domicilio Real y Legal, Tel\u00e9fono, Fax.<br \/>\nB.3 Nombre y apellido de la persona que retire el Pliego de Bases y Condiciones en CONDICIONES GENERALES DEL LLAMADO A CONCURSO<br \/>\nC.1 Persona capacitada: de acuerdo a la legislaci\u00f3n vigente del territorio nacional.<br \/>\nC.2 Condiciones que deber\u00e1n observar los oferentes:<br \/>\nC.2.1 Constituir domicilio legal en la ciudad de San Juan.<br \/>\nC.2.2 Aceptaci\u00f3n de la jurisdicci\u00f3n administrativa en la provincia y Tribunales ordinarios en la Ciudad de San Juan.<br \/>\nC.2.3 Representante legal y t\u00e9cnico: el Oferente deber\u00e1 designar el representante legal radicado en el pa\u00eds.<br \/>\nC.3 Asociaciones: dirigirse al IPEEM para m\u00e1s informaci\u00f3n.<\/p>\n<p>D) VENTA DEL PLIEGO<br \/>\nD.1 El Pliego podr\u00e1 adquirirse en la sede del IPEEM, cuyo valor se establece en d\u00f3lares estadounidenses Cinco Mil (U$S<br \/>\n5.000).<\/p>\n<p>E) PRESENTACION DE LAS OFERTAS<br \/>\nE.1 La Oferta se deber\u00e1 presentar en la sede del IPEEM en el d\u00eda y hora fijada.<br \/>\nE.2 Para la validez de la LA PRESENTACION Y RESTRICCIONES<br \/>\nF.1 \u2013 La Oferta deber\u00e1 presentarse en dos (2) ejemplares de un mismo tenor redactada en forma clara, completa y en idioma castellano.<br \/>\nF.2 \u2013Todos aquellos documentos redactados en idioma extranjero deber\u00e1n acompa\u00f1arse con su correspondiente<br \/>\ntraducci\u00f3n al castellano.<br \/>\nF.3 \u2013 La documentaci\u00f3n de los Sobres N\u00b0 1 y N\u00b0 2 deber\u00e1 ser foliada.<br \/>\nF.4 -No se admitir\u00e1 el acuerdo expreso entre dos o m\u00e1s oferentes.<\/p>\n<p>G) INFORMACI\u00d3N COMPLEMENTARIA<br \/>\nG.1 El IPEEM quedar\u00e1 facultado para solicitar a los oferentes informaci\u00f3n complementaria y referencias, como toda otra<br \/>\ndocumentaci\u00f3n referida al concurso.<\/p>\n<p>H) CONTENIDO DEL SOBRE N\u00b01<br \/>\nH.1 Datos de identificaci\u00f3n del oferente (y cada una de las empresas integrantes en caso de asociaciones empresarias).<br \/>\nH.2 Domicilio real y legal en la Ciudad de San Juan.<br \/>\nH.3 Copia autenticada del contrato constitutivo y de las actas mediante las cuales se designaron las actuales autoridades.<br \/>\nH.4 Organizaci\u00f3n del oferente con el responsable de cada \u00e1rea.<br \/>\nH.5 Director del Proyecto propuesto para el presente concurso.<br \/>\nH.6 Capacidad t\u00e9cnica y operativa.<br \/>\nH.7 Operaciones mineras de exploraciones, explotaciones, beneficio, procesamiento y comercializaci\u00f3n de productos<br \/>\nmineros generales que est\u00e9n realizando.<br \/>\nH.8 Capacidad Financiera.<br \/>\nH.9 Capacidad bancaria y comercial.<br \/>\nH.10 Memorias, balances y estado de resultados de los \u00faltimos tres ejercicios.<br \/>\nH.11 Documentaci\u00f3n complementaria.<br \/>\nH.12 Trabajos ejecutados del mismo tipo que el requerido, debiendo adjuntar antecedentes.<br \/>\nH.13 Declaraci\u00f3n jurada de no ser deudor del fisco nacional y\/o provincial.<\/p>\n<p>I) CONTENIDO DEL SOBRE N\u00b0 2<br \/>\nI.1 El sobre N\u00b0 2 contendr\u00e1 la oferta propiamente dicha, debiendo contener como parte integrante e indispensable lo<br \/>\nsiguiente:<\/p>\n<p>I.1.1 Programa de Prospecci\u00f3n y Exploraci\u00f3n. Las fases de trabajo propuestas, las que deber\u00e1n contemplar<br \/>\nun plazo m\u00e1ximo de cinco (5) a\u00f1os calendario. Public tender<\/strong><br \/>\n<strong>2. Direct contract<\/strong><\/p>\n<p>In both procedures, the company must submit the following legal documentation:<\/p>\n<p>a) Corporate data including articles of incorporation, name, and address.<br \/>\nb) Previous experience in similar projects.<br \/>\nc) Technical and operational capabilities.<br \/>\nd) Financial capacity.<br \/>\ne) Appointment of a technical representative and a legal representative.<br \/>\nf) Guarantee of maintence the offer, among other, and a financial offer and work and investmen. formalized with an Exploration Contract and a 5 year option for Exploitation,<br \/>\nexploration contract with option to exploit. The company will formalize a 5 years exploration program which may be extended by mutual agreement of the parties.<\/p>\n<p><strong>SUMMARY OF THE CALL FOR PUBLIC BIDDING COMPETITION:<br \/>\n<\/strong><br \/>\nA) DOCUMENTATION OF THE BIDDING<br \/>\nA.1 &#8211; Terms and Conditions Document and its Annexes.<br \/>\nA.2 &#8211; Minutes and Documents of the call for Bidding.<br \/>\nB) REQUIREMENTS FOR ACQUIRING THE TERMS<br \/>\nB.1 Name and Legal Entity.<br \/>\nB.2 Physical and Legal Address, Telephone, Fax.<br \/>\nB.3 First and last name of the person who collects the Terms and Conditions on behalf of another.<br \/>\nB.4 The acquisition of a Terms and Conditions document enables the bidder to bid for one or more areas subject to this competition.<br \/>\nC) GENERAL CONDITIONS OF THE CALL FOR COMPETITION<br \/>\nC.1 Qualified Person: according to the current legislation of the national territory.<br \/>\nC.2 Conditions to be observed by bidders:<br \/>\nC.2.1 Establish legal domicile in the city of San Juan.<br \/>\nC.2.2 Acceptance of administrative jurisdiction in the province and ordinary courts in the City of San Juan.<br \/>\nC.2.3 Legal and technical representative: The Bidder must designate a legal representative who resides in the country.<br \/>\nC.3 Associations: Refer to IPEEM for more information.<br \/>\nD) SALE OF THE TERMS<br \/>\nD.1 The Terms can be acquired at the IPEEM headquarters, at a costof Five Thousand US Dollars (U$S 5,000).<br \/>\nE) SUBMISSION OF OFFERS<br \/>\nE.1 The Offer must be submitted at the IPEEM headquarters on the specified day and time.<br \/>\nE.2 For the validity of the submission, the Bidder must deposit a closed and sealed envelope, containing Envelope No. 1 and Envelope No. 2, both closed, sealed, and signed.<br \/>\nF) FORMAT OF THE SUBMISSION AND RESTRICTIONS<br \/>\nF.1 &#8211; The Offer must be submitted in two (2) copies of the same tenor, drafted clearly, completely, and in the Spanish language.<br \/>\nF.2 &#8211; All documents drafted in a foreign language must be accompanied by their corresponding translation into Spanish.<br \/>\nF.3 &#8211; The documentation of Envelopes No.1 and No. 2 must be labeled as such.<br \/>\nF.4 &#8211; Express agreements between two or more bidders will not be admitted.<\/p>\n<p>G) ADDITIONAL INFORMATION<br \/>\nG.1 The IPEEM will be authorized to request additional information and references from the bidders, as well as any other documentation related to the competition.<\/p>\n<p>H) CONTENTS OF ENVELOPE NO.1<br \/>\nH.1 Identification data of the bidder (and each of the companies involved in case of business associations).<br \/>\nH.2 Physical and legal address in the City of San Juan.<br \/>\nH.3 Authenticated copy of the articles of incorporation and minutes by which the current authorities were appointed.<br \/>\nH.4 Organization of the bidder with the person responsible for each area.<br \/>\nH.5 Director of the Project proposed for this competition.<br \/>\nH.6 Technical and operational capability.<br \/>\nH.7 Mining operations for exploration, exploitation, beneficiation, processing, and commercialization of general mining products being conducted.<br \/>\nH.8 Financial capability.<br \/>\nH.9 Banking and commercial capability.<br \/>\nH.10 Annual reports, balance sheets, and income statements for the last three fiscal years.<br \/>\nH.11 Supplementary documentation.<br \/>\nH.12 Executed works of the same type as required, with attached records.<br \/>\nH.13 Sworn declaration of not being a debtor to the national and\/or provincial treasury.<\/p>\n<p>I) CONTENTS OF ENVELOPE NO. 2<br \/>\nI.1 Envelope No. 2 shall contain the actual offer and must include the following as an integral and indispensable part:<\/p>\n<p>I.1.1 Prospecting and Exploration Program. The proposed work phases, which must cover a maximum period of five (5) calendar years.
